Rhode Island law allows pre-judgment interest at a rate of twelve percent. R.I. Gen. Laws § 9-21-10 (1997). In medical malpractice cases, interest accrues not from the date of the incident, but from the earliest of the following: the date the insurer was notified of the claim, the date the health care provider was notified, or the date the lawsuit was filed.
